1. การยอมรับเงื่อนไข

การใช้ Viva Ads (adviva.vivavizion.com — “บริการ”) ถือว่าคุณยอมรับเงื่อนไขฉบับนี้และ นโยบายความเป็นส่วนตัว ของเรา หากคุณไม่ยอมรับ โปรดงดใช้บริการ

By using Viva Ads (adviva.vivavizion.com — the “Service”) you accept these terms and our Privacy Policy. If you do not accept them, please do not use the Service.

2. บริการของเรา

Viva Ads เป็นแพลตฟอร์มบริหารโฆษณาสำหรับธุรกิจ SME ไทย คุณเชื่อมต่อบัญชีโฆษณา ของคุณเอง (Meta / Google / TikTok / Lazada / Shopee) เพื่อดูผลการดำเนินงานในที่เดียว รับคำแนะนำจาก AI และสั่งโปรโมทโพสต์เป็นโฆษณา — ทุกการกระทำที่มีผลต่อการใช้จ่ายต้องได้รับการอนุมัติจากคุณ

Viva Ads is an ad-management platform for Thai SMEs. You connect your own ad accounts (Meta / Google / TikTok / Lazada / Shopee) to read performance in one place, receive AI suggestions, and run promotions — every action that affects spend requires your approval.

3. บัญชีผู้ใช้และความรับผิดชอบ

• คุณต้องเป็นเจ้าของหรือได้รับสิทธิ์ในบัญชีโฆษณาทุกบัญชีที่นำมาเชื่อมต่อ
• คุณรับผิดชอบการรักษาความลับของรหัสผ่าน และกิจกรรมทั้งหมดที่เกิดขึ้นภายใต้บัญชีของคุณ — แจ้งเราทันทีที่ [email protected] หากสงสัยว่าบัญชีถูกใช้งานโดยไม่ได้รับอนุญาต
• เนื้อหาโฆษณาที่คุณสั่งโปรโมทต้องถูกกฎหมายไทยและนโยบายของแพลตฟอร์มโฆษณานั้น ๆ และคุณต้องปฏิบัติตาม Terms of Service ของแต่ละแพลตฟอร์มควบคู่ไปด้วย
• ห้ามใช้บริการเพื่อหลอกลวง สแปม หรือละเมิดสิทธิ์ของบุคคลอื่น

You must own or be authorized to use every ad account you connect. You are responsible for safeguarding your password and for all activity under your account — notify [email protected] immediately if you suspect unauthorized use. Ad content you promote must comply with Thai law, each ad platform's policies, and that platform's own terms of service. Fraud, spam, and infringement of others' rights are prohibited.

4. ค่าบริการและการเรียกเก็บเงิน

บริการคิดค่าสมาชิกรายเดือนตามแพ็กเกจ (Starter ฿990 / Growth ฿2,990 / Agency ฿9,900 ต่อเดือน — ราคา ณ วันประกาศใช้) ราคาปัจจุบันและรายละเอียดแพ็กเกจเป็นไปตาม หน้า Pricing ณ เวลาที่ชำระเงิน การยกเลิกมีผลเมื่อสิ้นรอบบิลปัจจุบัน โดยไม่คืนเงินส่วนของรอบที่ใช้ไปแล้ว

The Service is billed as a monthly subscription (Starter ฿990 / Growth ฿2,990 / Agency ฿9,900 per month at the effective date). Current prices and plan details are those shown on the Pricing page at the time of payment. Cancellation takes effect at the end of the current billing period; used periods are not refunded.

5. ข้อตกลงความปลอดภัยด้านงบประมาณ

• โฆษณาที่สร้างผ่าน Viva Ads ถูกสร้างในสถานะหยุดชั่วคราว (paused) เสมอ — จะเริ่มใช้จ่ายก็ต่อเมื่อคุณสั่งเปิดเอง
• งบประมาณทุกตัวเป็นเพดานที่คุณกำหนดเอง ระบบไม่เพิ่มงบเกินเพดานโดยไม่ได้รับอนุมัติ
• ทุกการกระทำที่ทำให้เกิดการใช้จ่าย (เปิดโฆษณา เพิ่มงบ อนุมัติคำแนะนำ AI) ต้องได้รับการอนุมัติจากคุณก่อนเสมอ

Ads created through Viva Ads are always created paused — they spend only after you activate them. Every budget is a ceiling you set; the system never raises spend above it without approval. Every spend-affecting action (activating an ad, raising a budget, accepting an AI suggestion) requires your approval.

6. ค่าโฆษณา (Ad Spend)

ค่าโฆษณาไม่ได้เรียกเก็บผ่าน Viva Ads — แพลตฟอร์มโฆษณา (Meta, Google, TikTok, Lazada, Shopee) เรียกเก็บจากวิธีชำระเงินที่คุณผูกไว้กับแพลตฟอร์มนั้นโดยตรง Viva Ads ไม่รับผิดชอบต่อการเรียกเก็บเงิน ข้อพิพาท หรือนโยบายการคืนเงินของแพลตฟอร์มโฆษณา

Ad spend is not billed through Viva Ads — each ad platform (Meta, Google, TikTok, Lazada, Shopee) charges the payment method you registered with that platform directly. Viva Ads is not responsible for platform billing, disputes, or platform refund policies.

7. ข้อจำกัดความรับผิด

บริการให้ “ตามสภาพ” (as is) คำแนะนำจาก AI เป็นข้อมูลประกอบการตัดสินใจ ไม่ใช่การรับประกันผลลัพธ์ เท่าที่กฎหมายอนุญาต ความรับผิดรวมของบริษัทจำกัดไม่เกิน ค่าสมาชิกที่คุณชำระในช่วง 12 เดือนก่อนเหตุแห่งการเรียกร้อง และบริษัทไม่รับผิดต่อความเสียหายทางอ้อม เช่น กำไรที่คาดว่าจะได้รับ หรือผลการดำเนินงานของแคมเปญโฆษณา

The Service is provided “as is.” AI suggestions are decision support, not a guarantee of results. To the extent permitted by law, our total liability is limited to the subscription fees you paid in the 12 months preceding the claim, and we are not liable for indirect damages such as lost profits or ad campaign performance.

8. ข้อมูลส่วนบุคคล (PDPA)

การเก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลเป็นไปตาม นโยบายความเป็นส่วนตัว ของเรา ซึ่งสอดคล้องกับ พ.ร.บ. คุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA)

Collection, use, and disclosure of personal data are governed by our Privacy Policy, consistent with the Personal Data Protection Act B.E. 2562 (PDPA).

9. การระงับและการยกเลิกบริการ

คุณยกเลิกบัญชีได้ทุกเมื่อจากหน้า Settings — ข้อมูลทั้งหมดถูกลบภายใน 30 วันหลังการยกเลิก ตามนโยบายความเป็นส่วนตัว บริษัทอาจระงับหรือยกเลิกบัญชีที่ละเมิดเงื่อนไขนี้ ใช้บริการโดยผิดกฎหมาย หรือค้างชำระค่าบริการ โดยจะแจ้งให้ทราบตามช่องทางที่ลงทะเบียนไว้เว้นแต่กฎหมายห้าม

You may cancel your account at any time from Settings; all data is deleted within 30 days of cancellation per the Privacy Policy. We may suspend or terminate accounts that breach these terms, use the Service unlawfully, or have unpaid fees, with notice to your registered contact unless prohibited by law.

10. กฎหมายที่ใช้บังคับและการติดต่อ
